These terms apply when you use emaliaboutique.com or buy from us. "Emalia Boutique", "we" and "us" mean Emalia Boutique, a store operated by Zobaidi LTD, a company registered in England and Wales (company number 14607399). By using the site or placing an order, you agree to these terms, our Privacy Policy, our Shipping Policy and our Refund Policy.

Who can buy from us

You must be at least the age of majority where you live to place an order. We ship only to addresses in the United States. Our products are sold for personal use, not for resale.

Your account

If you create an account, keep your login details private. You are responsible for activity on your account and for keeping your contact and address details up to date.

Product information

We describe each product using its confirmed specifications and show it in real photographs. Colors can look different from screen to screen, and garment measurements can vary slightly from piece to piece. We may update descriptions, change our range or limit order quantities at any time.

Prices and payment

Prices are in US dollars. You pay the price shown when you place your order. We don't currently collect sales tax; if that changes, any tax will be shown at checkout before you pay. Accepted payment methods are listed on our Billing Terms page.

If we find a pricing or description error in an order you have placed, we will contact you before shipping. You can then confirm the order at the correct details or cancel it for a full refund.

Orders

Our order confirmation email confirms that we received your order. We may decline or cancel an order, for example when an item is unavailable, the price was listed in error, the address is one we can't ship to, or the payment looks fraudulent. If we do, we refund you in full.

You can cancel an order within 24 hours of placing it by contacting us with your order number.

Shipping and delivery

Shipping within the United States is free. Delivery times are estimates, as described in our Shipping Policy. Ownership and risk of loss pass to you when the order is delivered to the address you gave us.

Returns and refunds

You can return eligible items within 30 days of delivery, as described in our Refund Policy. Sale items and gift cards are final sale.

Promotions and gift cards

Any promotion we run states its own conditions, and those conditions apply alongside these terms. Gift cards can't be exchanged for cash except where the law requires it.

Our content

The Emalia Boutique name and logo, and the text, images and design of this site, belong to us or our licensors. You may use the site for personal shopping, but you may not copy, republish or sell its content without our written permission.

Using the site

Don't use the site for anything unlawful, to send spam, to submit false information, to impersonate anyone, to scrape or copy content in bulk, or to interfere with its security or operation. We may suspend accounts or block access when these terms are broken.

Other companies' services

Our store runs on Shopify, and payments, wallets and deliveries are handled by other companies under their own terms. Shopify is not a party to your purchase. We are not responsible for websites we link to.

Warranties

To the extent the law allows, the site and its content are provided as is. Nothing in these terms limits warranties or consumer rights that you have under the law of your state and that can't be excluded.

Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability for any claim related to an order is limited to the amount you paid for that order. This doesn't apply where the law doesn't permit it.

Indemnity

If you break these terms or the law while using the site and a third party makes a claim against us as a result, you agree to cover the reasonable costs of that claim.

Governing law and disputes

If you have a problem, please contact us first; most issues can be settled quickly by email or phone. These terms are governed by the laws of England and Wales. This doesn't remove any protection you have under the consumer laws of the US state where you live, and you may bring a claim in your local courts where your state's law allows.

General

If any part of these terms can't be enforced, the rest still applies. If we don't enforce a right straight away, we haven't given it up. You may not transfer your rights under these terms without our consent.

Changes to these terms

We may update these terms from time to time. The version on this page when you place an order applies to that order.
